Payment is charged to your Apple Account at confirmation of purchase. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription in your Apple Account settings after purchase. Prices may vary by region.
These Terms of Use ("Terms") are a legal agreement between you and Contra Frumentum Inc., 8R The Grn, Dover, DE 19901-3618, United States ("we", "us") governing your use of the That Friend application ("the App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse-engineer, resell, or redistribute the App.
That Friend is a personal memory aid. It helps you record and recall details about people you meet.
The App is designed for you to record information about other people. You are solely responsible for what you record and how you use it. You agree that you will:
You are the controller of the information you record. We provide the tool; the content is yours.
You retain all rights to the content you create in the App. Because your content is stored on your device, you are responsible for maintaining your own backups. We are not able to recover content lost through device loss, damage, or app deletion.
The App is free to use for up to 10 saved people, with full functionality. Saving additional people requires an active subscription. If a subscription lapses, people you have already saved remain accessible and editable — the limit applies only to adding new ones.
Subscriptions are billed by Apple. Refunds are handled by Apple under the App Store Terms of Service; we cannot issue refunds directly. Any unused portion of a free trial, where offered, is forfeited when you purchase a subscription.
To transcribe your voice and generate portraits, the App may send text and audio to third-party processing providers. See our Privacy Policy for details.
We may update, change, or discontinue features of the App. We will make reasonable efforts to avoid removing functionality you rely on without notice.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that transcriptions, generated portraits, summaries, or suggested questions will be accurate or complete. They are aids to your memory, not statements of fact.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST DATA, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.
You agree to indemnify and hold us harmless from claims arising out of your misuse of the App or your violation of these Terms or of any third party's rights.
You may stop using the App at any time by deleting it. We may suspend or terminate your licence if you materially breach these Terms.
Apple is not a party to these Terms and has no responsibility for the App. Apple has no obligation to provide maintenance or support for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules.
